ORCHARD PARK, N.Y. (WIVB) - Orchard Park residents will cast their ballots next month on whether to downsize the Town Board.

The vote is set on September 23rd, eight days after the primary election.

The town attorney says state law prohibits the vote from happening on primary day or during the general election in November.

Meantime, there's stil no word on when the West Seneca Town Board will be downsized.

According to published reports, the county Board of Elections has delayed a decision on when the board can be trimmed from five members to three.

Voters decided last June to downsize the board. Now there's a question of whether the plan will take effect next year as intended or, if it will have to wait until 2012.
