State justice expected to resign

BUFFALO, N.Y. (WIVB) - A state supreme court justice is expected to resign because of an affadavit he signed.

News 4 has confirmed the State Commission on Judicial Conduct is investigating Supreme Court Justice Joseph Makowski's intervention in a DWI case pending against a local attorney.

Published reports indicate Justice Makowski provided a written statement on behalf of attorney Anne Adams, a former prosecutor in the Erie County District Attorney's office.

Adams was charged with Driving While Intoxicated by Hamburg police back in September.

One of the issues the State Commission is looking into is an affidavit Makowski apparently submitted on Adams's behalf that she did not appear to be drunk.

The Buffalo News is reporting Makowski is expected to resign his post on the state court within a matter of days, but Justice Makowski was on the bench Friday morning hearing cases.
