Bruce Smith found guilty of DUI

It was the third time Smith was charged

VIRGINIA BEACH, VA (WIVB) - A former Buffalo Bill and future Hall of Famer Bruce Smith has been found guilty of driving under the influence.

It was the third time Smith was charged with driving under the influence. He was acquitted in one case, and a 1997 conviction was dismissed.

Thursday, there was another conviction for an incident in May in Virginia Beach.

The 46-year old former Bills defensive end went to trial in Virginia Beach and was found guilty of DUI, speeding and refusing to take a breath test.

His lawyer challenged the charges, citing Smith's football knee injuries as the reason he could not walk a straight line, and saying football concussions led to him struggling with other field sobriety tests.

But the judge didn't buy it. Smith was given a 90 day suspended jail term, fined $350 dollars, and had his license suspended for a year.

Smith had no comment after the conviction. His lawyer says he will appeal. The appeal will be heard in Virginia Beach Circuit Court on August 27th. That's about three weeks after Smith will be formally inducted into the Pro Football Hall of Fame in Canton.
