BUFFALO, N.Y. (WIVB) - Buffalo Police are investigating a fatal accident that happened late Tuesday night at the foot of Ontario Street.

Police say a 25-year-old female driver was turning off Niagara onto Ontario around 10:30 p.m. and struck a man sitting on a guard rail. The 49-year-old male victim was taken to Kenmore Mercy Hospital, where he later died. The driver was taken to ECMC where she continues to be treated.

No charges have been filed at this time, but accident investigators are still looking into the fatal crash.
