Accused breakdancing vandal speaks out

ELMA, N.Y. (WIVB) - He finally caught a break. Now, the accused teenaged breakdancer is speaking out after learning felony charges against him will be dismissed.

District Attorney Frank Sedita told News 4 his office questioned whether criminal charges should ever have been brought against Ryan Baczkiewicz for breakdancing at a party. He had been charged with a D Felony, but in six months that charge will be dismissed.

Baczkiewicz said, "I feel like humiliated in a way."

The ordeal is over for Ryan Baczkiewicz who had been charged with felony criminal mischief after breakdancing at a party at this house in Elma. A week later, he was taken to the Holding Center after being handcuffed and led away from his house.

He was hauled into Elma Town Court and charged with causing thousands of dollars of damage to a wood floor during the party as an uninvited guest. Then witnesses said the girls throwing the party had allowed some heavy underage drinking while their parents were away and that Ryan had been invited.

Baczkiewicz said, "There was other people dancing. Everybody was drinking. There was jello shots, beer pong, cases of beer all over the place."

"This was ridiculous. If you're going to throw a party like that and have underaged drinking, you should be responsible for your own action. You should know something that could possibly happen, and to be immature like that and pin it on somebody else and put someone through this kind of torment, it's just unheard of," said Baczkiewicz's friend, Pat Eck.
