Attorney sentenced for ripping off 401K

BUFFALO, N.Y. (WIVB) - A Buffalo attorney was sentenced to eight months home confinement on Wednesday for embezzling close to $70,000 from a 401K.

Thomas Barnes, 55, embezzled the money from Franbuilt in Lockport starting in February 2006 and continuing until the business closed in January 2007. Barnes amended the 401K plan, making himself a trustee, which enabled him to steal the funds.

Barnes will pay restitution for all of the money he took and will be on probation for two years.
