CASSADAGA, N.Y. (WIVB) - Troopers pulled a man over on Route 60 in Cassadaga on Sunday when they say they saw him texting behind the wheel.
After pulling 27-year-old Michael Vanevery of Sherman over, State Police say they could smell alcohol and placed him under arrest for DWI. Vanevery's license had already been revoked for a previous DWI and he is required to have an ignition interlock device in his vehicle, which police say he did not have.
On top of texting while driving, troopers charged him with felony DWI, having a BAC greater than .08 percent, operating a motor vehicle without an ignition interlock device, and first degree aggravated unlicensed operation. He returns to court in March.
