DUNKIRK, N.Y. (WIVB) - Sheriff's Deputies responded to a report of a vehicle off the road on Rt. 5 in the Town of Dunkirk at about 5:05 a.m Sunday morning.

The driver of the vehicle Marcos A. Torres told deputies he swerved to miss a deer and ran off the roadway.

After further investigation, Torres was arrested for DWI.

He is expected to answer to the charges in the Town of Dunkirk Court on a later date.
