Ex lawmaker to learn fate for stealing

BUFFALO, N.Y. (WIVB) - A former Buffalo city councilman will learn his fate Wednesday morning for embezzling money that was earmarked for his district. Brian Davis pleaded guilty to stealing from an organization receiving federal funds back in May, and Wednesday he will be sentenced.

Federal prosecutors are seeking a two-year prison sentence for the former Ellicott council member, while Davis’ lawyers are seeking leniency with probation and community service.

In May, U.S. Attorney William Hochul said, “Here we have a person who had actually earned the trust of taxpayers and the residents who ultimately voted for him and yet as today's developments showed he rethanked them for their vote by stealing money.”

Davis diverted over $48,000 in City of Buffalo discretionary funds to his own use and the use of others, while a Buffalo Common Council member between 2006 and 2010.

Back in 2009, Davis pleaded guilty to two misdemeanor charges of using campaign contributions for his personal use. When he gave his resignation as council member, he said, “ I accept the consequences of my actions. My conduct was not acceptable and I do want to apologize.”

Davis faces up to 10 years in prison and a $250,000 fine, but judicial guidelines recommend a sentence of between 10 to 16 months and restitution of the $48,000.
