BUFFALO, N.Y. (AP) - A grand jury has indicted a New York man on charges he beat his girlfriend's 3-year-old son to death after the child awoke in the middle of the night.
Erie County District Attorney Frank Sedita III says Friday that 30-year-old Justin Crouse of Salamanca is charged with second-degree murder and first-degree manslaughter in the death of Gage Seneca on the Cattaraugus Indian Reservation.
Crouse is to be arraigned in state Supreme Court on Monday.
At the time of his arrest earlier this month, Crouse pleaded not guilty to second-degree murder in Brant Town Court.
Erie County Sheriff's officials have said Crouse hit Gage in the head about 1 a.m. March 5 after finding him out of bed. The child's mother and grandmother found him unresponsive several hours later.
