BUFFALO, N.Y. (WIVB) - A Buffalo man has been indicted by a federal grand jury on charges of perjury. Prosecutors say Michael Acoff knew less about a murder than he claimed to.
The 22-year-old testified he had first hand knowledge of the January 19, 2011 murder of Harold McCain, who was shot and killed inside a clothing store. Acoff told a grand jury that he received a phone call from McCain's alleged killer after the murder and went to pick up the suspect.
But prosecutors say Acoff was lying, and that he did not pick up the alleged killer nor receive a phone call from him. In fact, prosecutors allege Acoff never had any conversations about the murder of McCain.
Tyrone Brown, a member of the Bailey Boys Gang, has been indicted on charges he murdered McCain.
If Acoff is convicted of perjury, he faces a maximum sentence of five years in prison.
