AMHERST, N.Y. (WIVB) - The Erie County District Attorney’s Office says a Niagara Falls man pleaded guilty to a motorcycle crash that claimed two lives, and left a woman seriously injured.
The DA’s office says 53-year-old David Smith pleaded guilty to first-degree vehicular manslaughter, second-degree vehicular assault and driving while intoxicated. These charges are higher than those he could have been convicted of, had he gone to trial.

Smith admits to driving drunk when he lost control of his motorcycle, drove off Tonawanda Creek Road and onto a bike path in November. The crash caused the death of 26-year-old Jocelyn Elberson and 81-year-old Sheila Pelton. The crash caused seriously physical injuries to 79-year-old Foster Pelton.
Smith faces a maximum prison sentence of 15 years in prison, when he is sentenced in March.
