Man charged with felony under new law

COVINGTON, N.Y. (WIVB) - A Wyoming County man is being held in jail without bail after arguing with his mother and ripping a phone off a wall.

The sheriff's office arrested 39-year-old Timothy Foss on Tuesday and charged him under a new law that took effect January 23 of this year. Aggravated Family Offense, a class E felony, can be applied whenever a person has previously committed a family offense as defined by NYS and has any conviction of a family offense within the last five years.

Deputies say Foss has been verbally abusing his mother for a period of time and that during an argument at their home on Lemley Road in the Town of Covington, Foss ripped a phone off the wall to prevent his mother from calling for help. Foss was also charged with criminal mischief.

Deputies did not say what other family offense Foss has faced. He was arraigned in Perry Court and taken to the Wyoming County Jail without bail.
