Man claims officer planted evidence

BUFFALO, N.Y. (WIVB) - A Buffalo man could face up to 30 years behind bars, when sentenced for two counts of second-degree criminal possession of a weapon. A jury found the prior felon guilty Friday, even though his defense counsel tried to argue that police planted evidence in the case.

The Erie County District Attorney’s Office says 63-year-old John Harris, of Buffalo, was involved in a domestic violence incident with his girlfriend when police approached him. The D.A.’s office says Harris began a foot chase, but was ultimately apprehended by police.

During the chase, Harris allegedly tried to discard a loaded revolver. More investigation led police to a second loaded pistol at Harris’ home. Because Harris is a prior felon, he was possessing the weapons unlawfully.

The DA’s Office says attorneys for Harris argued that a rogue police officer planted evidence against him. Harris also filed a federal lawsuit against the judge for not dismissing the case, and that the DA violated his civil rights by obtaining a court order with his DNA.

D.A. Frank Sedita said, “We are thankful that the jury saw through the completely bogus claims of the defendant...”

Harris is scheduled to be sentenced January 9th.
