Man convicted of sex with child

BUFFALO, N.Y. (WIVB) - A man has been convicted of engaging in sexual intercourse with a child multiple times over a four-year period.  The Erie County District Attorney’s Office says 50-year-old Everton Smith was found guilty of  first-degree course of sexual conduct against a child and third-degree rape.

The DA’s office says the victim initially delayed reporting the incidents, because Smith told her no one would believe her and she would be abandoned if she disclosed the sexual abuse. According to the DA’s office, Case refused to permit the defense to get past the rape shield law, despite their attempts to portray the child as sexually promiscuous and untrustworthy.

Sedita praised the work of those involved in the case, saying, “"Because of their dedication and professionalism, another sexual predator has been successfully brought to justice."

Smith faces a maximum prison sentence of 29 years when sentenced in April.
