Man with infant in car charged with DWI

ELMA, N.Y. (WIVB) - A Williamsville man and others face several charges including Endangering the Welfare of a Child after being involved in an incident Thursday night in the Town of Elma.

Police responded to a report of a vehicle sliding off the road around 9:30 p.m., where an altercation later broke out amongst those inside. The occupants were found on the median of the highway in the snow when crews arrived to the scene.

Police say the operator of the vehicle was Maximillian Mathis, who appeared to be intoxicated at the time of the incident, and was driving the vehicle with a 2-month-old baby inside.

The infant's parents, Daniel Hart and Angela Mead of Buffalo, were charged with Endangering the Welfare of a Child because police say they knowingly allowed their child to be driven by someone under the influence of drugs.

Following his evaluation, Mathis was charged with a Felony DWI by Drugs under Leandra’s Law, as well as Endangering the Welfare of a Child and numerous traffic violations.

Everyone in the vehicle refused further medical treatment following evaluation by emergency crews. The infant was turned over to a family member and deputies notified Child Protective Services, which will conduct their own investigation.

All parties involved were taken to the Erie County Sheriff’s Elma substation to be processed for arrest and will appear in court in February.
