ELMA, N.Y. (WIVB) - Troopers say a man trying to push his car to a gas station when his tank ran dry was tanked.
Sunday morning around 1:30 a.m., troopers spotted Jeffrey Dennee, 37, of Buffalo pushing his car out of the middle of the intersection of Seneca Street and Transit Road in Elma. Dennee told police he ran out of gas and was pushing his car to the station on the corner.
But when troopers smelled alcohol, they had Dennee run field sobriety tests. When he failed, Dennee was arrested and charged with DWI. Back at the station, troopers say his BAC was .17 percent.
He will appear in court later this month.
