ELLICOTTVILLE, N.Y. (WIVB) - Deputies arrested a man they say cut a corner while turning right, driving over a sidewalk and cutting off oncoming traffic.
Cattaraugus County Sheriff's deputies pulled over 56-year-old Christopher Fogle of Ohio last Friday around 11:15 p.m. after witnessing Fogle turning onto Route 219 off Valerian Way in Ellicottville, cutting across the sidewalk and a lane of traffic. Deputies say Fogle had a plastic cup containing an alcoholic beverage in the middle console.
Fogle was charged with aggravated DWI when deputies determined his BAC was above .18 percent, as well as consumption of alcohol in a motor vehicle, improper right turn, failure to yield and driving an unregistered motor vehicle.
He is being held on $2,500 bail.
