Buchholz drunk driver gets 1-3 years

LANCASTER, NY (WIVB) -

One man's deadly decision to drink and drive robbed a Lancaster family of their son, and a young teen of his life and on Thursday he was sentenced to prison.

Micheal Ettipio, 23, was sentenced to 1 to 3 years in prison for for the hit and run crash on Lake Ave. that killed 14 year-old Bryce Buchholz.  Ettipio pleaded guilty to vehicular manslaughter in May.

The courtroom was packed Thursday morning with family and friends.  They wore orange in memoriam of their son and friend; Buchhulz was riding an orange BMX bicycle with his best friend Ryan when was struck and killed by Ettipio's vehicle.

Buchhulz was killed instantly.  Ettipio never stopped and drove home but a witness followed the defendant and brought him back to police at the scene.

At the time of his arrest, police say Ettipio's blood alcohol level was nearly three times the legal limit.

The District Attorney released surveillance video Thursday of Ettipio falling over drunk at the Forest View Restaurant and then walking in circles trying to find his car.

The DA said he chose to release the video to show the community that by simply doing nothing when someone is drunk and when someone chooses to drink and drive there are tragic consequences.

Buchholz's family has a civil case pending against the restaurant but the DA can't legally prosecute the business criminally.
