BATAVIA, N.Y. (WIVB) - The jury's decision in the trial of a Batavia woman facing assault charges under New York's Granny Law may rest on surveillance video.
Jacquetta Simmons is accused of punching an elderly Walmart greeter in the face on Christmas Eve last year. Simmons says it was an accident, but prosecutors presented powerful evidence on Thursday they say shows the contrary.
Several witnesses say Simmons' punch was no accident and surveillance video appears to bolster their testimony. On the video, you can see the 26-year-old pull back her arm and hit 70-year-old Grace Suozzi in the face, sending her flying across the floor.
What you can't hear while watching the video is the language involved, which witnesses say was laced with profanities.
Suozzi had asked to see Simmons' receipt, following store policy.
The store surveillance cameras continued to catch the action outside of the store. The video shows Simmons running as she is chased by customers. In the parking lot, customers used their own vehicles to box her car into the handicapped spot where she parked.
The trial could wrap up by the end of the week.
