BUFFALO, N.Y. (WIVB) - A judge sentenced 18-year-old Joshua Nieves-Castro to 21 years in state prison for fatally shooting Jay Amelio Nieves after a bar fight in May on Wednesday.
Though he's going to prison, the victim's family says full justice was not served.
Nieves-Castro had pleaded guilty to first degree manslaughter in January. The victim, who had served in the National Guard, had tried to break up the fight.
His family says Wednesday's sentence does not honor the kind of life that he led.
His sister, Suzanne Rodriguez, said, "We were very heartbroken and very upset. We were hoping he was going to get the maximum amount and they kind of had lienency on him. Unfortunately he didn't have any lienency on my brother."
Nieves-Castro did apologize to the family, but they say it did not seem sincere and they cannot forgive him for taking away their loved one.
The maximum sentence for a manslaughter conviction is 25 years.
