LOCKPORT, N.Y. (WIVB) - The teenager who was behind the wheel in a crash on August 24th that killed his friend is now facing charges.
The Niagara County Sheriff's Office investigated the fatal accident and found 19-year-old Dillon Sherman of Lockport pulled onto Slayton Settlement Road into the path of a dump truck, causing the accident that killed his passenger, 18-year-old Collin Enzinna . Sherman has been charged with failure to stop while entering the roadway from a driveway and failure to yield the right of way.
The dump truck driver, 35-year-old Jason Albert of North Tonawanda, is also facing charges. Deputies say he was driving an unregistered dump truck with an improper registration for agricultural use. Authorities say the truck also exceeded the weight limit set by law and did not have proper DOT stickers. Albert was hauling topsoil under the name A&K Topsoil Services in Lockport.
Sherman will appear in court in October to answer the charges.
