BATAVIA, N.Y. (WIVB) - A Batavia woman who punched an elderly Wal-Mart greeter will not have to wait behind bars while she appeals her case.
An appellate judge has stayed the prison sentence of Jacquetta Simmons. Justice Rose Sconiers ruled that the five-year sentence did not fit Simmons' conviction for second degree assault.
At the original sentencing, Simmons' victim spoke of the daily struggles she still has as a result of the warrant-less attack.
