BATAVIA, N.Y. (WIVB) - A Batavia woman who punched an elderly Wal-Mart Greeter is out of jail - for now.
Jacquetta Simmons posted $50,000 bail. A judge sentenced her to serve five years behind bars for second-degree assault under the recently enacted "Granny Law."

But an appellate judge has stayed the prison sentence pending an appeal hearing. Simmons' attorney argues the sentence is too harsh considering she is a first-time offender.
