Coke plant facing 15 count indictment

TONAWANDA, N.Y. (WIVB) - A federal grand jury has indicted Tonawanda Coke and its Environmental Control Manager.

The company and its Environmental Manager are charged with numerous Clean Air Act violations and other federal crimes. The indictment charges Tonawanda Coke and Mark Kamholz with 15 separate Clean Air Act crimes.

At least five counts involve the illegal release of toxic benzene into the air in the town of Tonawanda. The company and Kamholz are also charged with obstruction of justice for hiding evidence during a 2009 EPA inspection. The indictment also charges the company with disposal of hazardous waste without permits.
