BUFFALO, N.Y. (WIVB) - Buffalo area McDonald's restaurants are charging "new" taxes for food purchases.

There's the "Take Out Tax" , and an "Eat In Tax."

Call 4 Action checked out the "new" taxes to find out they are just McDonald's own technical code names for the sales tax due on food orders.

The code names are important because some states exempt carry out orders from sales tax, but do tax sit down meals.

Statement from a McDonald's Corporate spokesperson in Oak Brook, IL:

"The Eat-in tax and Take-out tax lines simply refer to the sales tax stipulated by the county and state taxing authorities in the communities in which we operate. The reason we need to differentiate between the two is because some areas of the U.S. are exempt from paying tax if the purchase is made through the drive-thru. McDonald's is committed to delivering a great restaurant experience for every customer at every visit."
