NIAGARA FALLS, N.Y. Press release - Thursday night at around 12:42 troopers observed while
patrolling on Niagara Falls Boulevard a red Toyota traveling
northbound in the city of Niagara Falls.
The operator, Tara C. Hayes was seen crossing over into the
southbound lane driving in an erratic manner. Hayes stated that the
reason she was driving in such a manner was due to her cell phone
usage and the fact that she was attempting to put on makeup.
Hayes was persistent that she only had one beer at the time
and after failing several field sobriety tests was informed that
she was being placed under arrest for driving while intoxicated.
Hayes became highly belligerent and began yelling
obscenities, and then proceeded to kick Trooper Persinger in the
shin. Hayes explained later that the reason she kicked Trooper
Persinger was because she had sore feet.
Hayes was charged with using a cell phone while operating a
motor vehicle, failure to keep right, driving while intoxicated
(blood alcohol content .09%), and resisting arrest.
Hayes was remanded to the Niagara Falls holding center with a
bail of $850, awaiting to be arraigned on Thursday.
