GOWANDA, N.Y. (WIVB) - A man accused of shooting at a highway worker while he was trying to clear snow is scheduled to be in court Tuesday.

Forty-year-old Thomas Barone is charged with assault, criminal mischief and reckless endangerment. Police say he shot a bb gun as a highway worker was plowing the sidewalk in front of his home. Glass shattered hitting that worker, sending him to the hospital.

Police say Barone said he was mad the plow was pushing snow into his driveway.
