SOMERSET, N.Y. (WIVB) - A multi-billion dollar Verizon data center in Niagara County is now facing a legal hurdle.

A State Supreme Court lawsuit challenges the validity of fast-tracked re-zoning, cheap hydropower and tax breaks already granted the project. An Article 78 proceeding seeks a full blown environmental impact study before the project can proceed.

Justice Ralph Boniello has scheduled a hearing for January in State Supreme Court.
