TONAWANDA, N.Y. (AP) - A town justice in Tonawanda ordered a 77-year-old woman thrown in jail because she won't stop her dog from barking at night.
Barbara Creighton has been fined repeatedly since 2009 for violating an ordinance requiring dog owners to keep their animals from waking neighbors.
But the problem hasn't ceased. Justice Daniel Cavarello sentenced her to 24 hours in jail on Wednesday.
Creighton didn't wind up having to serve the time after some confusion on court paperwork.
The Buffalo News reports that the Erie County sheriff declined to imprison her after getting documents indicating that she had already been in jail twice previously. Town police say that was a mix-up.
The newspaper says it knocked on Creighton's door and left her a phone message, but didn't get a response.
