ATTICA, N.Y. (WIVB) - Four prison guards accused of roughing up an inmate at the Attica Correctional Facility are now in the clear.
News 4 has confirmed that a Wyoming county judge has dismissed the indictment against Keith Swack, Sean Warner, Matthew Raddemacher, and Erick Hibsh. All four men had been suspended without pay after the alleged assault last August that left an inmate with broken bones and fractures.
The judge dismissed the charges "without prejudice," which means the Wyoming County District Attorney could still bring the case before another grand jury. It is unclear if that will happen.
