Should be released by mid-week

FORT HOOD, Texas (KXAN) - Without providing any details due to federal regulations, Fort Hood officials issued a brief statement Monday morning which announced that suspected Fort Hood shooter Maj. Nidal Hasan has been hospitalized.

Officials said he is in good condition and expected to be released within the next 48 hours.

On Friday, Hasan's attorney's filed another appeal to the ruling that he must shave his beard before his trial for the November 2009 shooting begins. He is accused of killing 13 people and injuring 32 others. Army regulations prohibit the wearing of a beard.

A former Army psychiastrist, Hasan has claimed he grew the beard due to his religious beliefs and that his Muslim faith requires it. However, while on active duty, Hasan did not wear a beard.

His attorneys filed two appeals on Friday, citing that the Religious Freedom Restoration Act allows Hasan to wear the beard as the trial gets under way. The government has until Friday, Sept. 28, to issue a ruling.

Hasan's trial was due to begin on Aug. 20, but since that time, there has been delay after delay over the issue of his beard.

Hasan faces the death penalty if he is convicted of the attack on the Army post near Killeen.
