BEMUS POINT, N.Y. (WIVB) - A man who police say was driving 94 MPH in a 65 MPH zone was also allegedly intoxicated and had a child in his vehicle.
James Spitale, 36, of Findley Lake was stopped near Bemus Point on Saturday around 6:30 p.m. State Police say Spitale was drunk and had a child less than 16-years-old in the vehicle. He has been charged with felony aggravated DWI under Leandra's Law, felony aggravated unlicensed operation, endangering the welfare of a child and speeding.
After learning Spitale has a prior DWI conviction in the last 10 years, he was additionally charged with felony DWI. But that wasn't all the charges placed against him.
Troopers say Spitale was in the company of an adult woman who has an active order of protection against him through Jamestown City Court. And Spitale has been previously convicted of second degree criminal contempt. As a result, State Police charged him with felony first degree criminal contempt.
Spitale was arraigned and taken to the Chautauqua County Jail on $2,500 bail.
