WALES, N.Y. (WIVB) - A motorcyclist injured when he went over a guardrail is facing DWI charges - and so is the biker who was riding with him.
Erie County Sheriff's deputies were called to Warner Hill Road in the Town of Wales just before midnight on Tuesday. Thirty-year-old Jacob Balon of South Wales crashed into a guardrail on his motorcycle, going over the side and down an embankment.
While on the scene, deputies say his friend, 31-year-old David Yox of Glenwood, attempted to leave the area on his own motorcycle. Authorities stopped him and after field sobriety tests, determined he was drunk. Deputies say Yox's BAC was .13 percent.
After being flown by Mercy Flight to ECMC, blood was drawn to determine Balon's BAC.
Both Balon and Yox have both been charged with DWI.
