According to the arrest report, obtained by News 4, Buffalo Police have charged 25-year-old Ediberto Rodriguez with second-degree assault. Rodriguez is not the girl's father, but is her mother's boyfriend.
The arresting officer writes, Rodriguez intended to hurt the girl by slamming her into a wall and pushing her down the stairs. The report further explains the girl suffered a crushed spleen, a fractured pelvis and internal bleeding, but gave no reason behind the alleged assault.
Rodriguez was arraigned in city court this weekend, where he pleaded not guilty to the charges. Sources say he defended himself in court, saying he was high on drugs and blacked out when the alleged abuse happened inside of this home.
