BUFFALO, N.Y. (WIVB) - A Buffalo man accused of attacking his girlfriend's four-year-old daughter, faced a judge Thursday.
Ediberto Rodriguez is facing two counts of second-degree felony assault. Thursday in court, through an interpreter, Rodriguez waived his right to a felony hearing and those charges are now going before a grand jury.
Rodriguez is accused of severely beating his girlfriend's daughter, who is still recovering at Women and Children's Hospital. More charges could come, depending on the young girl's injuries.
Wednesday, Buffalo Police Commissioner Dan Derrenda said Rodriguez has a history of child abuse. But according to Rodriguez's attorney John Nuchereno, there are family court files of abuse or neglect, but that doesn't mean anything actually happened.
Rodriguez will likely not be in court again for quite a while according to his attorney. The young girl we are told is recovering. The victim's mother, according to Nuchereno, "is supportive of this man."
