STOW, N.Y. (WIVB) - Troopers say a man driving with an open can of beer in his vehicle also had nearly a pound of pot stashed inside.
State Police stopped 36-year-old Brian Waller of Dunkirk at a road check on Rt. 394 in Stow on Wednesday. Troopers say they could smell marijuana in the vehicle, and initiated a search, which is when they say they found an open can of beer and nearly a pound of pot.
Waller was arrested and charged with felony third degree criminal possession of marijuana. He was also ticketed for having an open container.
After being arraigned, Waller was taken to Chautauqua County Jail on $3,000 bail.
