BUFFALO, N.Y. (WIVB) - The case against a Springville teenager accused of killing his girlfriend's baby is headed to trial. Sixteen-year-old Dylan Schumaker appeared in State Supreme Court Tuesday morning for a pre-trial hearing.
He pleaded not guilty in April to second-degree murder charges. Prosecutors say he beat one-year-old Austin Smith to death while the boy's mother was at work.
Nineteen-year-old Ashlee Smith left her son, Austin, inside a Cochran Avenue home in Springville in March, trusting him to the care of her boyfriend, Schumaker. Four hours later, Schumaker called 911, reporting the baby was unresponsive. Erie County Sheriff Tim Howard says deputies arriving on scene immediately noticed the substantial bruising all over Austin's body, and especially around his face.
Deputies attempted to perform CPR on Austin, who was taken to the hospital, where he was pronounced dead. Schumaker is being charged as an adult.
