BUFFALO, N.Y. (AP) - Two teens accused in a November home invasion in which an elderly church deacon was beaten have been charged with murder following the victim's death earlier this month.
Justice Feggans, 18, pleaded not guilty Wednesday in state Supreme Court. His 19-year-old co-defendant, Jordan McKinnon, was arraigned Friday. Both were charged in sealed indictments with second-degree murder and first-degree burglary in the attack on 96-year-old Levi Clayton, Erie County District Attorney Frank Sedita III said.
The retired auto worker and World War II veteran suffered a broken jaw and other injuries inside his Buffalo home Nov. 24 and spent weeks in the hospital. An autopsy determined that complications due to blunt force trauma sustained in the attack caused his April 10 death.
Surveillance cameras captured video of the attackers outside the home and showed Clayton tossing a lamp out a window while trying to keep them at bay. The images, released shortly after the break-in, led community members to rally outside the house to appeal for information about the suspects' identities.
A 22-year-old and 17-year-old are still being sought by police for questioning.
Feggans' lawyer, Jason Schmidt, declined to comment Wednesday on the indictment. A call to McKinnon's attorney, William Purks, wasn't immediately returned.
If convicted, the pair faces a maximum prison sentence of 25 years to life. They are due back in court next month.
