BATAVIA, N.Y. (WIVB) - Jacquetta Simmons will spend five years in jail for a brutal attack on 70-year-old Grace Suozzi last Christmas Eve.
Surveillance video captured the 27-year-old woman punching the elderly Walmart greeter in the face in Batavia. That video would prove pivotal in helping the jury make their decision.
Suozzi spoke at court on Wednesday, saying, "What she has taken away from me is irreplaceable. She took away my independence and my pride. Working at Walmart, and at the Board of Elections, helped me to pay my bills. She has taken my joy and replaced it with physical pain and emotional trauma."
Suozzi said she can't even see a Walmart commercial on TV without feeling that trauma. Time she should spend with her friends and family, she said, is instead consumed by doctors' visits and counseling.
"I do not have a normal life anymore. She has taken away my health, that I worked so hard to maintain without medication. Now I'm forced to be on blood pressure and pain medication," she said.
Genesee County Judge Robert Noonan asked Simmons if she had anything to say, before he handed down her sentence.
Simmons said, "I just want to say how truly sorry I am, about the incident that happened. I hate that Grace and her family had to endure all the things that they're going through right now."
Genesee County District Attorney Lawrence Friedman said, "I don't think anything could be further from the truth. She absolutely did not accept any responsibility for what she did."
Friedman had asked for the maximum sentence of seven years - under a state law, the "Granny Law," that makes it a felony to intentionally injure a person 65 or older. Simmons' attorney, Earl Key, barely commented as he left court.
"We intend to appeal. That's it," Key said.
