ALDEN, N.Y. (WIVB) - An Alden man has been arrested, accused of breaking into his victim's home through an unlocked door and attacking her while she showered.
The Erie County Sheriff's Office says the attack happened in the early morning hours of December 15th at a home on Broadway in Alden. The victim was taken to ECMC after the attack where a rape kit was performed.
During the investigation, 25-year-old Sam Muscarella denied attacking the victim and voluntarily submitted a DNA sample. Muscarella was arrested Tuesday morning when the DNA test came back positive.
Erie County Sheriff's Sr. Det. James Hatch said, "We haven't had a case like this in Alden in my memory. This is a very serious case. Fortunately, in our jurisdictions, it's fairly rare. We take it very seriously and we conducted a very intensive investigation which had the results of Mr. Muscarella being taken into custody today."
Muscarella has been charged with rape, criminal sexual act, second degree burglary, and sex abuse. Acting Village Justice Joseph Randazzo set bail at $100,000 and issued an order of protection for the victim Tuesday evening in the Village of Alden Court.
