DEPEW, N.Y. (WIVB) - Many people hop in the pool in the sweltering heat. But every town and village is different and some are suddenly enforcing laws they have had on the books for years.
Depew resident Anne Marie Bemish said, "It's not like we can afford to take them to Darien Lake or anything."
Bemish has had a pool for her grandkids for about 10 years now, a four-foot model with plastic posts that has been there for about four years in open view to the street. But the other day she got a letter from the Village of Depew notifying her that she was in violation of building codes and the pool requires a $50 building permit each year that she puts it up.
"They said it's a relatively new law in the last five years," Bemish said.
In addition to the building permit, she needs an electrical survey done by NYSEG and she says, "I have to put in a dedicated electrical line. That I can' afford."
We went to Gary Pool to find out how many people are faced with regulations like these.
Gary Pool salesman Seth Schupbach said, "People are always caught off guard by the extra regulations and stuff they have to go through. There are certain towns that are worse than otehrs, Grand lsland for instance, they have a set list of electrical installers that can do it for you and it has to be somebody on that list."
"Amherst and Clarence both require cartridge filters now. Town codes have gotten worse and worse over the past four years," he added.
Bemish said, "I just think that this is geting out of hand. This wasn't meant to avoid taxation, it was meant to be an affordable alternative."
Bemish will now figure out how much this will all cost her, and if she can even keep the pool up.
Schupbach advises that you be aware or ask what the regulations are in your town before you buy a pool.
