Ikaika is a killer whale owned by SeaWorld Parks and Entertainment but has been on loan to Marineland in a breeding agreement that began in 2006.
The Niagara Falls Review reports that the Ontario Court of Appeals ruled Wednesday that Marineland must return Ikaika to the U.S. marine park
SeaWorld filed court documents last year asking for the whale to be returned because they were concerned about the its physical and psychological health. The park refused to return the nine-year-old whale.
Veterinarians examining the whale last May reportedly gave it a clean bill of health.
