Former substitute teacher charged with assaulting student deemed incompetent by court

A former substitute teacher accused of assaulting a child at a Buffalo elementary school has been found incompetent. 

The misdemeanor charge against Mark Magavern was dismissed Thursday following two forensic examinations. The court issued a final order of observation committing him to a mental health institution for up to 90 days. 

Magavern was accused of punching and choking an eighth grade student at a summer program at Southside Elementary School in July. 

He was fired from his position.
