New report on death of India Cummings sparks renewed call for change

There’s a renewed call for change after a new report was released on the death of an inmate in Erie County.

India Cummings was an inmate at the Erie County Holding Center in 2016. She died from cardiac arrest at Buffalo General after spending 17 days at the holding center.

She was originally taken to jail after a carjacking.

Her death was ruled undetermined, but earlier this week, the state Commission of Correction’s medical review board said her death should be ruled a homicide due to medical neglect.

“The report in itself does not necessarily establish the truth,” Erie County Sheriff Tim Howard said. “They have expressed an opinion. This is pending litigation so it would be inappropriate to comment further.”

News 4 was told the only one who can change the autopsy is the pathologist who performed the examination.

The pathologist said he would consider making that change if there was any new information. He says the report did not offer anything new.
