ELLICOTTVILLE, N.Y. (WIVB) - New York State Police responded to an Ellicottville Bar Saturday night for reports of a possible shooting.
Police say they got to the scene at the corner of Monroe Street and Washington Street just after 9:30 p.m.
Further investigation revealed 25-year-old Damien Marvin of Salamanca and a 41-year-old male had an altercation in a nearby bar.
Both parties exited the bar and continued the altercation outside, according to authorities.
During the altercation, Marvin shot one round into the abdominal area of the 41-year-old victim with a legally possessed Glock.
The victim was taken to ECMC for injuries where he is listed in critical condition.
Marvin surrendered to Troopers without incident and remains in Cattaraugus County Jail. He was charged with 1st Degree Assault.
Police say this is still an ongoing criminal investigation.
